Privacy Policy

1.             Scope; Incorporation; Definitions

 

This Privacy Policy (this Policy) governs how Professional Office Services Inc./mydigitalnotices.com (Provider) collects, uses, discloses, retains, and otherwise processes Personal Information/mydigitalnotices.com in connection with the Services described in the Terms of Use and End User License Agreement between Provider and you (the Agreement), and is incorporated into the Agreement by reference.  Capitalized terms not defined in this Policy have the meanings given in the Agreement.  For purposes of this Policy: (a) Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household; (b) Account Information has the meaning stated in the Agreement; and (c) Transactional Documents and Billing Entities have the meanings stated in the Agreement.

 

2.             Personal Information

 

(a)            Information Collected.  Provider may collect the following categories of Personal information, to the extent you provide it or it is generated through your use of the Services: (a) identifiers and contact information (such as name, email address, mailing address, and similar contact details); (b) Account Information and account-linking identifiers relating to one or more Billing Entities; (c) authentication and security credentials and related verification information; and (d) usage and access information relating to your access to and use of the Services and your access to Transactional Documents. 

 

(b)           Web Browser Cookies.  Mydigitalnotices.com may use “cookies” to enhance your experience.  Your web browser places cookies on its hard drive for record-keeping purposes and sometimes to track information.  You may choose to set your web browser to refuse cookies or to alert you when cookies are being sent.  If you do so, some portions of the site may not function properly.

 

(c)            Transactional Documents.  Provider does not control the substantive content of Transactional Documents, which are determined by the applicable Billing Entity.

 

3.           How We Use Personal Information


Provider may use Personal Information for the following purposes: (a) to provide, operate, maintain, and support the Services and to present, display, and deliver Transactional Documents through the Services; (b) to create, administer, and secure your account, including maintaining the confidentiality and security of account access and investigating suspected unauthorized access or misuse; (c) to verify information you provide and to manage security and compliance risks; (d) to communicate with you about the Services, including notices and other communications permitted under the Agreement; (e) to enforce the Agreement and protect the rights, safety, and security of Provider, you, Billing Entities, and others; and (f) to comply with applicable law and lawful requests from governmental authorities.

 

4.     How We Disclose Personal Information


Provider may disclose Personal Information as follows:

 

(a)            To Billing Entities.
To provide the Services, Provider may share with each applicable Billing Entity certain information relating to you and your use of the Services, including identifiers used to link your account with the Billing Entity, contact information, and information about your access to that Billing Entity's Transactional Documents.

 

(b)           To Service Providers.
Provider may disclose Personal Information to vendors and service providers that process information on Provider's behalf to support the Services (for example, hosting, security, customer support, and similar functions), subject to contractual obligations consistent with this Policy and applicable law.

 

(c)            For Legal and Security Reasons.
Provider may disclose Personal Information to comply with law, regulation, legal process, or governmental request, and to protect against, investigate, or respond to suspected fraud, security incidents, or violations of the Agreement.

 

(d)           Business Transfers.
Provider may disclose Personal Information in connection with an assignment permitted under the Agreement, including a merger, acquisition, corporate reorganization, or sale of all or substantially all of Provider's assets, subject to applicable law.


Your relationship with each Billing Entity, and the Billing Entity's own use of your information, are governed by the Billing Entity's privacy policies and terms.

 

5.     Data Security


Provider will employ commercially reasonable administrative, technical, and physical safeguards designed to protect the security and confidentiality of Personal Information processed through the Services, consistent with industry standards for similar services; however, no method of transmission over the internet or electronic storage is completely secure, and Provider cannot guarantee absolute security. You are responsible for maintaining the security and confidentiality of your account credentials and devices used to access the Services and for promptly notifying Provider of suspected unauthorized access or use.

 

6.      Accessing and Updating Your Information


You are responsible for ensuring that Account Information you provide is accurate, current, and complete, and for promptly updating it, as necessary. Where the Services make account management functionality available, you may update certain information through such functionality or by contacting Provider as described in the Agreement's contact and notice provisions. 

7.             Retention and Deletion


Provider may retain Personal Information for as long as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, enforce the Agreement, and maintain appropriate business records, unless a longer retention period is required or permitted by law.  Upon termination, Provider may, in its discretion and in accordance with its data retention policies and applicable law, deactivate or delete your account and associated data. Billing Entities may retain Transactional Documents and related information in accordance with their own policies and legal obligations.

 

8.             Privacy Policy Changes; Notice; Opt-Out


Provider may modify or update this Policy from time to time. Provider will indicate the date this Policy was last updated and may provide notice of material changes by posting the updated Policy through the Services, displaying a prominent notice within the Services, or sending you an email or other electronic communication at the contact information associated with your account. Unless otherwise required by applicable law, changes become effective on the date indicated, and your continued access to or use of the Services after the effective date constitutes acceptance. If you do not agree to an updated Policy, you must cease using the Services and terminate the Agreement in accordance with its termination provisions. To the extent Provider offers an opt-out or cancellation mechanism for certain processing activities, you may exercise it by terminating your use of the Services and closing your account as described in the Agreement.

 

9.              Governing Law; Jurisdiction


This Policy, and any dispute, claim, or controversy arising out of or relating to this Policy or Provider's processing of Personal Information in connection with the Services, shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of laws principles. Any dispute not subject to arbitration under the Agreement shall be brought exclusively in the District Court for Black Hawk County in the State of Iowa, and the parties consent to personal jurisdiction and waive objections based on venue or forum non conveniens.
